Thousands of pounds of premium, live Newfoundland and Labrador lobster took off from Gander International Airport this week aboard a FarCargo Boeing 757-233, destined for Madrid, Spain. The flight marks a major milestone in a bold new strategy to diversify seafood markets amid global trade headwinds.

Premium, live, cold-water lobster (the kind that’s earned a global reputation as the world’s best) were carefully prepped and packed by the Gander team before takeoff. Within hours, that same catch will be featured on menus in Spain, demonstrating how air cargo can bridge oceans and deliver premium Newfoundland and Labrador seafood to international buyers in record time.

This shipment is part of an initiative to expand markets globally and in response to the current global geopolitical climate. It is the result of more than two years of planning and collaboration between public and private partners — a model for what’s possible when different sectors work together toward a common goal.

Led by PF Collins International Trade Solutions, Whitecap International Seafood Exporters, Eastern Fish Markets Ltd., Happy Adventure Sea Products (1991) Ltd., the Gander International Airport Authority (GIAA), Allied Aviation Services Company, Hardy Fish Co Ltd., and other seafood industry leaders, the new seafood air cargo and market diversification project is setting a foundation for sustainable global reach. Closely aligned with the long-term vision of establishing Gander as a seafood export hub, the initiative provides vital and immediate support in process development, logistics coordination, international marketing, and strategic sales planning.

Darrell Roche, President and CEO at Whitecap, noted that the project was 2 years in the making, and the success of the inaugural flight was a proud day for everyone at Whitecap and its many partners.

“The success of this project is a result of dedication and perseverance by numerous companies and funding agencies who trusted us and believed in this project. Without the support of those funding agencies, none of this would have happened.”

Roche emphasized the role of close collaboration and geography in the success of the project.

“We have demonstrated to our European customers that they will receive the highest quality product from us. Without Bob Hardy’s persistence, experience and encouragement, we would not have stayed with this project. His support was instrumental,” Roche said.

Whitecap would also like to recognize their partner and customers in Spain that have been instrumental in guiding the project.

While the project’s start was considered a success, Roche emphasized that the real work starts now.

Mark Wheaton, General Manager of Eastern Fish Markets, underscored the launch’s importance in shaping the province’s identity in the global seafood industry.

Eastern Fish Markets specialize in premium Newfoundland & Labrador wild lobster sourced from first-class harvesters who ensure superior quality.

“Our team of harvesters source these animals from the cold, clean waters of the North Atlantic, which are considered to be one of the healthiest ocean habitats in the world. We are committed to community values, animal welfare, and environmental sustainability, emphasizing careful handling of live harvest to maintain quality.”

Raymond Collins, President of PF Collins, stressed the importance of speed and precision in maintaining that quality.

“When global trade shifts overnight, the only solution is to move faster. This project gives our seafood exporters a direct runway to premium international markets. PF Collins is proud to support the logistics planning, aircraft bookings, and freight forwarding documentation that help get our province’s top-tier seafood into the hands of global buyers quickly and efficiently.”

Roche added that this project is a powerful example of how public and private sectors can work together to achieve a common goal. The project partners acknowledge the valuable advice and support of the Atlantic Canada Opportunities Agency, the Atlantic Fisheries Fund, the Department of Industry, Energy and Technology, and the Department of Fisheries, Forestry and Agriculture.

“Every participating partner played an essential role in turning this vision into reality, and the project stands as a model for future collaborations focused on sustainability, innovation, and economic growth,” he said.

While the inaugural flight was focused on lobster destined for the Spanish market, the broader strategy includes expansion into France, the United Kingdom, and eventually, high-value Asian markets like South Korea and Japan. This plan not only provides short-term protection for Newfoundland and Labrador’s seafood industry but also creates the opportunity for the province to establish long-lasting, resilient trade corridors for the years ahead. The consortium looks forward to delivering premium-quality, fresh North Atlantic cod from Newfoundland and Labrador to many customers across Europe this fall.

As the Gander seafood hub continues to evolve, the success of this pilot project marks the beginning of a new chapter – one where Newfoundland and Labrador seafood is no longer just ocean-harvested, but also runway-ready.

Information c/o: Canada Border Services Agency

Effective October 21st, the CBSA Assessment and Revenue Management (CARM) system will become the official system for importers and other trade partners. This system will be the only system to account for goods and pay duties and taxes owed to the Canada Border Services Agency (CBSA). If you import to Canada regularly, or you are a one-time importer, you must register for CARM and obtain an RPP (Release Prior to Payment) Bond. If you have already registered, you should have a seamless transition with limited to no interruptions. If you have not yet registered, please do so immediately. Registration is required prior to the CBSA CARM Cutover Period, please see below.

Cutover Period

CBSA has announced a Cutover Period from October 4th (4pm EST) to October 21st (3am EST). A cutover period is intended for CBSA to migrate systems and functionality in preparation for CARM implementation day. During this period, some CBSA legacy systems, such as the Customs Commercial System (CCS) and Customs Automated Data Exchanges (CADEX), will be retired.

The CARM Client Portal (CCP) will not be available during the cutover period. This means every Canadian importer must be registered prior to October 4th. Failure to do so will result in significant delays in the release of your goods.

As of October 21st, all duties and tax payments will need to be paid directly to CBSA. More information can be found here CBSA/payments.

Register in the CARM Client Portal
All importers must register their business in the CCS and delegate authority to their customs brokers to allow them to continue to transact business with CBSA on their behalf.

Obtain Financial Security
All importers must post their own financial security with CBSA to maintain the same RPP as previously done by a customs broker on your behalf. Importers have the option between an annual surety bond or a cash security deposit. Due the sheer volume of bonds, it is wise to obtain your annual surety bond today.

Make Payment Arrangements
CBSA is expecting payment directly from the Importer and holds the importer fully responsible.
Information c/o Department of Finance Canada

Background

The Government of Canada has released a notice of intent to impose surtaxes on Chinese steel and
aluminum in response to unfair Chinese trade practices.

The Government recently assessed unfair Chinese trade practices in the electric vehicles sector. Concerns
were raised regarding unfair competition from China, including pervasive subsidization, and lack of
rigorous labour and environmental standards in the steel and aluminum sector. Stakeholders indicated
Chinese producers are benefiting from unfair, non-market acts, policies and practices and jeopardizing
investments for producers in Canada.

Canada, like-mind trading partners, and the Organization for Economic Cooperation and Development
(OECD) have long noted concerns with Chinese structural overcapacity and impacts on global trade. China
is the world’s largest steelmaker, producing over 1 billion metric tonnes in 2023 (54% of global
production). Since softening global demand, China has increased its capacity by 18.6 million metric tonnes
(more than Canada’s total production capacity) since 2018.

The United States and Mexico have identified similar concerns, in May of 2024 the US announced an
increase in its section 301 tariffs on a range of products imported from China, including steel and
aluminum.

Scope of Surtax

The federal government intends to impose a 25% surtax on imports of steel and aluminum products from
China and a 100% surtax on all Chinese-made Electric Vehicles, including electric and certain hybrid
passenger automobiles, trucks, buses, and delivery vans. The initial list of goods subject to this surtax and
those related to EVs can be found & downloaded below.

The final list of goods subject to surtaxes will be announced by October 1st, 2024, with the surtaxes taking
effect on October 15th, 2024. The surtaxes will not apply to Chinese goods that are in transit to Canada on
the day on which these surtaxes come into force. The government intends to review this change within
one year.

Information c/o: Canada Border Services Agency

According to an April 19, 2024 News Release published by the Canada Border Services Agency (CBSA) and Government of Canada, the CBSA Assessment and Revenue Management (CARM) digital initiative which was initially scheduled to launch on May 13, 2024 will now be rescheduled to launch for importers in October 2024.

The release states that CARM will launch internally at the CBSA on May 13, as planned, to advance the Agency’s compliance and enforcement efforts, however, the CBSA will reschedule the launch for trade chain partners to October 2024. CBSA has stated that this will ensure that the Agency can support partners as they start using CARM. Therefore, until the fall, trade chain partners will continue to operate as they have.

You can read the full official news release from CBSA regarding these changes here.

As of right now, PF Collins does not have additional information regarding this rescheduling and we are still learning what the potential impacts may be. We intend to provide further updates as information becomes available.

Canada’s approximately 243,000 km coastline is the longest in the world, and our marine sectors continue to contribute significantly to provincial, regional, and national economies. Commercial Marine Shipping has long been interconnected with Canada’s history, from its environmental and cultural impacts to its effects on the urban development of major cities and rural communities alike.

International trade between Canada and the rest of the world is heavily facilitated by marine shipping – despite competing modes of commercial transportation such as road, rail, and air – and is commonly the only means of moving essential goods to remote island locations in Canada’s northern areas above the tree line. Estimates suggest that the economic impact of marine shipping’s role in facilitating international marine trade is equal to about 1.8% of the Canadian GDP, or about $30 billion in 2016.

In the past, the captain of each vessel was the primary representative of the shipowner in each of the ports that the ship, its crew, and its products travelled to. Over time, with the rise of international commerce and leaps in technology, it became impractical for captains to continue with this responsibility thus giving rise to marine agencies and marine agents.

In this article, we look at the responsibilities of a Marine Agent and the benefits of hiring one for your international shipping.

Certifications & Licencing

Ensuring that the marine agency service provider you are hiring is fully-licenced and possesses the appropriate certifications that are necessary to meet industry standards should be a top priority when looking for a suitable marine agent. These certifications guarantee that your marine agent is qualified to handle the duties of your port call from arrival to departure.

Experience & Knowledge

As previously mentioned, Marine Agents are experts of the local port which they service. Marine Agents must be fully conversant with all appropriate local and national regulations and requirements relating to the port, area, or sector in which they operate. Marine Agents must also have a wide range of relevant contacts and good relationships with local suppliers to provide the level of service and support necessary to smoothly coordinate a vessel’s port call. Much of this compulsory knowledge is gained through years of experience in the industry and after the handling of thousands of port calls.

Communication & Availability

Marine Agencies and Agents begin relaying vital information between port authorities and ships (and vice versa) before a vessel has even left its home country. Constant & proficient communication is a skill that experienced Marine Agents have mastered to provide excellent customer service to a ship’s crew. A marine agency that values open communication, promptly addresses your questions and concerns, and keeps you informed throughout the entire port call is what you should look for. In addition, the availability of a marine agent in the event of an emergency or differing time zones should be 24/7; quick response times can minimize downtime and ease tensions if a problem were to arise.

Although the job of a Marine Agent is dynamic, can change from day to day, and doesn’t allow for typical “9 to 5” working hours, those who enjoy breaking up the monotony thrive in a high-pressure environment position like a Marine Agent.

Paying Your Duty & Taxes in CARM Release 1

If you are currently registered in CBSA’s CARM client portal, you are able to make payments towards your CBSA 15-digit Business Number account. Payments made in the CARM client portal or any other manner should only be made by GST Direct or by having a RPP Duty Bond in place.

GST Direct

GST Direct has been arranged via your Customs Broker. Release of goods is secured on your Customs Broker’s Bond. Your Customs Broker will make payment on the Duty, Excise Tax, & SIMA directly to the CBSA and supply you with a monthly statement on the 25th of each month outlining the GST portion. In turn, the Importer will make payment directly to CBSA for the GST amount provided by your Customs Broker. Payment must be made by the last business day of the same month.

RPP Duty Bond

The Importer has secured their own Release Prior to Payment Duty Bond and arranged with their Customs Broker to utilize the Importer bond to obtain release prior to payment. On the 25th of each month, your Customs Broker will supply you with a monthly statement outlining all Duties & Taxes. In turn, the Importer will make payment directly to CBSA for the total provided by your Customs Broker. Payment must be received by CBSA by the last business day of each month.

IMPORTANT NOTE

If you are on the GST Direct program, do not pay the Duty. Pay only the GST outlined on your Customs Broker’s statement provided.

Ignore the Statement of Account (SOA) and amount due shown on the CARM client portal until Release 2 is in effect.

The reason for this is that the CARM portal is utilizing the new date parameters that will be in place for CARM R2 (October 2023). CBSA is still calculating based on the current date parameters until the mandatory date CARM R2 is in effect. CBSA will allocate payments on the Importer’s 15 Digit Business Number based on the Release Prior to Payment (RPP) duty bond declared at the time of release. If the Importer pays outside of these programs, CBSA will not allocate to the Importer’s debt and it will stay as a credit on their account until the Importer makes a request to have it refunded. Your Customs Broker is still required to make payments to CBSA on the portion released against the Customs Broker’s RPP Duty Bond.

Once CARM R2 is mandatory, payments and Statement of Account (SOA) in the CARM portal will be accurate.

Importing a Vessel into Canada Governed
by Canada’s Coasting Trade Act

There are many rules and regulations that vessel owners/operators must consider when importing a vessel into Canada. The operation of foreign vessels in Canada is regulated by the Government of Canada’s Coasting Trade Act and enforced by several federal and provincial departments and agencies.

Below we provide an overview of the processes and procedures required when planning to import a boat into Canada. For your convenience, we have included the following Importing a Vessel into Canada Guide with additional details to download.

Canada’s Coasting Trade Act

The Coasting Trade Act protects Canada’s marine industry by limiting vessel operations within its waters to Canadian-registered, duty paid vessels. While priority is given to these vessels, there are provisions for the temporary entry of foreign or non-duty paid vessels. This is provided there are no Canadian-registered vessels available or capable to perform the required scope of work.

Foreign or non-registered, duty paid vessels must obtain a Coasting Trade Licence prior to beginning operations in Canada. Owners or operators (or agent on their behalf, such as PF Collins) must submit an application to the Canada Border Services Agency (CBSA) or the Canadian Transportation Agency (CTA). The success of the application is dependent upon the suitability and availability of any Canadian-registered vessels to complete the work.

Exemptions Under the Coasting Trade Act

Exemptions for Seismic Vessels

To improve access to better seismic data for offshore development, Canada’s 2012 Economic Action Plan amended the Coasting Trade Act to remove the requirement for foreign seismic vessels to obtain a Coasting Trade Licence when undertaking oil and gas exploration on the continental shelf of Canada. Seismic vessels must still obtain a Coasting Trade Licence when conducting activities in the Territorial Sea of Canada.

Exemptions for Importing a Vessel under CETA

In 2017, the Canada-European Union Comprehensive Economic and Trade Agreement (CETA) introduced provisions to allow European Union entities to provide specific services without the requirement of a Coasting Trade Licence. These services include:

Feeder service between the Ports of Halifax and Montreal

Repositioning of empty containers

Dredging services

Duty and Tax Considerations When Importing a Vessel

All vessels entering Canada for temporary periods must pay the applicable duty and tax.

Imported vessels are typically subject to a duty rate of 25% of the fair market value, prorated for each month the vessel is operating in Canada. The duty rate is also subject to any free trade agreements that apply (e.g. CETA).

In addition, imported vessels are subject to the federal Goods and Services Tax (GST), calculated at a rate of 5% of the monthly duty-paid value of the vessel. The GST is fully refundable when the importer is a GST-registered entity with the Government of Canada.

A federal Excise Tax is also applied on marine diesel fuel, added to the normal domestic fuel price.

Other Considerations

Immigration for Foreign Crew and Shore-Based Personnel

Foreign crew entering Canada to work onboard the vessel must obtain a work permit prior to employment.

Service Canada issues Labour Market Impact Assessments (LMIA) for crew onboard foreign vessels approved by the CBSA. When assessing applications, Service Canada expects Canadians to have the first opportunity to fill the positions. Therefore, the application process requires advertising for onboard positions and the inclusion of a succession plan for Canadian personnel.

Local petroleum boards may also require local benefits provisions be met for operations related to offshore oil and gas. Petroleum boards in Canada include the Canada-Newfoundland and Labrador Offshore Petroleum Board and Canada-Nova Scotia Offshore Petroleum Board.

Safety Inspections

As a pre-requisite for the issuance of a Coasting Trade Licence, the vessel must undergo inspection at its first port of call in Canada to ensure compliance with the safety requirements of Transport Canada, the Canadian Coast Guard, and the local petroleum board.

Who is a Non-Resident Importer?

A Non-Resident Importer (NRI) is a business based outside of Canada. They do not have a physical presence in Canada but imports goods into Canada under their own name. By registering as an Non-Resident Importer, your company becomes the Importer of Record into Canada.

Becoming the Importer of Record offers many benefits. For instance, the Importer of Record can include all costs of shipping and customs into one price to the customer. The sale resembles a domestic transaction for your Canadian customer, making your product easier to purchase.

However, the risk of becoming the Importer of Record is that you are responsible for complying with the many rules and regulations associated with importing goods into Canada under the Customs Act and Customs Tariff Act.

What are the Benefits of Becoming an NRI?

Reduced Costs

Non-Resident Importers do not need a physical establishment in Canada to sell to Canadian consumers. As a result, operating and overhead expenses associated with infrastructure, employees, warehousing, and distribution are reduced.

Being an NRI also contributes to savings within your supply chain. As both the exporter in your own country and the importer in Canada you are better able to estimate and control shipping and import-related costs. You are also able to consolidate shipments, further reducing these costs.

Supply Chain Control

As both the exporter and the importer, you control the shipping process. This allows you to manage the movement of your goods and potential bottlenecks in the supply chain. Becoming an NRI also allows you to create consistency in your import processes, reducing delays at the border and delivery times to customers.

Accessibility for Customers

NRIs can offer direct delivery to Canadian customers, removing the administrative costs and “hidden fees” often associated with buying products internationally.

Becoming the Importer of Record in Canada allows you to sell your products to customers on a Delivered Duty Paid (DDP) basis (Incoterms 2020), meaning you pay all the costs of delivering the goods door-to-door to your customer. As a result, you control the shipment tracking and your customer only pays the final online or invoice price.

Competitive in the Canadian Marketplace

Reduced costs and easier access for Canadian consumers allows you to compete more effectively and increase your sales and market share in Canada. As a Non-Resident Importer, your sales resemble domestic transactions to Canadian customers – similar to purchasing the products from a Canadian company.

What are the Responsibilities of an NRI?

The biggest risk of becoming a Non-Resident Importer is the responsibility for compliance with the many customs laws and regulations. As the Importer of Record, you are liable for submitting accurate and complete information to the CBSA, paying the applicable duty and taxes, and maintaining records.

Failure to submit the required information and payments may result in fines and penalties under the Administrative Monetary Penalty System (AMPS), confiscation of goods, or being prohibited from future importations.

1. Submitting Correct Information

Goods imported into Canada require specific information for clearance by CBSA at the border, including the following:

Correct tariff classification for the imported product

A Canada Customs Invoice (CCI) or commercial invoice detailing the same information as a CCI

A Certificate of Origin to apply preferential tariff treatment (e.g. CUSMA, CETA, etc.)

Additional information/documents for the imported product (e.g. import permits)

Tariff Classification

The Customs Tariff provides tariff classifications and rates of duty for thousands of products based on the Harmonized Commodity Description and Coding System (HS Code) – the universal coding structure used in international trade. As the Importer of Record, you are responsible for ensuring the tariff classification for your imported goods is correct on documentation submitted to the CBSA.

Canada Customs Invoice

All commercial shipments imported into Canada must include a commercial invoice. It must provide specific information, including, but not limited to:

The buyer and seller

Country of Origin

Price paid or payable

Quantity and description of the goods.

A Canada Customs Invoice (CCI) is required for shipments with Value for Duty of CAD $2,500 or more. For shipments valued under CAD $2,500, you may use a commercial invoice provided it details the same information as a CCI. NRIs may also submit both a CCI and commercial invoice with their shipment.

As an NRI your selling price will include duty, Goods and Services Tax (GST), customs brokerage, and freight/shipping costs. All charges must be stated on your commercial invoice so that duty and GST is calculated on the correct value.

Certificate of Origin

In order to take advantage of reduced or eliminated duty rates under a Free Trade Agreement, such as CUSMA or CETA, a Certificate of Origin or Origin Declaration must be provided at the time of customs clearance. NRIs benefit from the CUSMA Agreement in that a “blanket” CUSMA Certificate of Origin is only required once per year, covering all imported shipments into Canada for a one-year period.

Import Permits

Goods controlled and/or restricted from entering Canada require an Import Permit. Products listed on Canada’s Import Control List include certain steel, dairy, textile products, as well as military goods and firearms.

PGA Requirements

Depending on the nature of the product, your imports may be subject to Participating Government Departments and Agencies (PGA) requirements. For example, products affected by PGA regulations include food, pharmaceuticals, plants, and animals. CBSA provides a list of some of the most commonly imported commodities that may require permits and/or certificates from other federal government departments and agencies.

Valuation

In accordance with the Customs Act, a “Value for Duty” (VFD) must be declared for all goods imported to Canada. The primary method of valuation in Canada is the Transaction Value Method. Under this method, value for duty is based on the price paid or payable for imported goods with certain adjustments.

Non-Resident Importers face challenges when applying valuation methods to their products. As both the exporter and importer it is more difficult to demonstrate an arm’s length transaction and reliable invoice price. We recommend NRIs or importers without substantial operations in Canada contact us at import@pfcollins.com for further assistance when considering valuation.

Duty

The Customs Tariff provides tariff classifications and rates of duty for imported commodities based on the HS Code. As the Importer of Record, you are responsible for payment of duties owed on imported goods.

Taxes

Goods and services imported and sold in Canada are subject to a federal Goods and Services Tax (GST). NRIs carrying out business in Canada must register for the GST. You may also have to post a GST security bond.

The 5% GST rate applies to the duty paid value of the goods upon import. However, an NRI registered for GST can recover the GST paid the CBSA by claiming an Input Tax Credit (ITC).

An NRI who sells goods on a landed, duty-paid basis is not considered to be carrying out business in Canada. As a result, they are not required to register for the GST. In this scenario, the non-registered NRI is not eligible to claim the GST paid to CBSA. Therefore, they incorporate the GST into the selling price and transfers (or assigns) the Input Tax Credit to the Canadian customer.

In addition to the GST, each Canadian province has its own provincial sales tax to which an NRI must register. Taxes vary; some provinces have a Provincial Sales Tax (PST) and others a Harmonized Sales Tax (HST). Use the following calculator and rates table to determine the amount of tax that applies to each Province.

3. Maintaining Records as an NRI

Companies or individuals importing or exporting to/from Canada must maintain accurate records for 6 years plus the current year.

Under authorization from the CBSA, a Non-Resident Importer may designate a Customs Broker to prepare, submit, and maintain all shipment-related documentation and records. However, they must submit a request in writing to the CBSA for approval. In addition, NRIs may request authorization to maintain records outside of Canada by submitting a letter of undertaking to the CBSA.

How to Become a Non-Resident Importer in Canada

1. Apply for a Canadian Business Number (BN)

To become a Non-Resident Importer you must first obtain a Business Number (BN) from the Canada Revenue Agency (CRA) prior to importing into Canada. The Business Number is a unique 15-digit number companies in Canada use to transact with government agencies.

You will also need an import/export account. Import/export account numbers include your Business Number, plus the two-letter identifier ‘RM’ (e.g. 123456789RM0001). Your import/export account number is submitted to CBSA on customs clearance documents and are only used when importing or exporting.

To register for a Business Number, or add an import/export account to an existing Business Number, contact the CRA’s Business Window at 1-800-959-5525, or register online using the Business Registration Online (BRO) service.
