<p class="kt-adv-heading7850_5f82f0-a9 wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7850_5f82f0-a9">Thousands of pounds of premium, live Newfoundland and Labrador lobster took off from Gander International Airport this week aboard a FarCargo Boeing 757-233, destined for Madrid, Spain. The flight marks a major milestone in a bold new strategy to diversify seafood markets amid global trade headwinds.</p>



<p class="kt-adv-heading7850_015dab-b8 wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7850_015dab-b8">Premium, live, cold-water lobster (the kind that’s earned a global reputation as the world’s best) were carefully prepped and packed by the Gander team before takeoff. Within hours, that same catch will be featured on menus in Spain, demonstrating how air cargo can bridge oceans and deliver premium Newfoundland and Labrador seafood to international buyers in record time.</p>



<p class="kt-adv-heading7850_045809-59 wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7850_045809-59">This shipment is part of an initiative to expand markets globally and in response to the current global geopolitical climate. It is the result of more than two years of planning and collaboration between public and private partners &#8212; a model for what’s possible when different sectors work together toward a common goal.</p>



<p class="kt-adv-heading7850_b501a6-ba wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7850_b501a6-ba">Led by PF Collins International Trade Solutions, Whitecap International Seafood Exporters, Eastern Fish Markets Ltd., Happy Adventure Sea Products (1991) Ltd., the Gander International Airport Authority (GIAA), Allied Aviation Services Company, Hardy Fish Co Ltd., and other seafood industry leaders, the new seafood air cargo and market diversification project is setting a foundation for sustainable global reach. Closely aligned with the long-term vision of establishing Gander as a seafood export hub, the initiative provides vital and immediate support in process development, logistics coordination, international marketing, and strategic sales planning.</p>



<p class="kt-adv-heading7850_7e0fc6-a5 wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7850_7e0fc6-a5">Darrell Roche, President and CEO at Whitecap, noted that the project was 2 years in the making, and the success of the inaugural flight was a proud day for everyone at Whitecap and its many partners.</p>

<p class="kt-adv-heading7850_2373e9-55 wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7850_2373e9-55">He also noted that partners such as Eastern Fish Markets and Happy Adventure Sea Products are world-class seafood processors that work with elite harvesters who are catching the highest quality lobsters in the world.</p>

<p>“We have demonstrated to our European customers that they will receive the highest quality product from us. Without Bob Hardy&#8217;s persistence, experience and encouragement, we would not have stayed with this project. His support was instrumental,” Roche said.</p>

<p class="kt-adv-heading7850_fa6b20-cf wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7850_fa6b20-cf">Whitecap would also like to recognize their partner and customers in Spain that have been instrumental in guiding the project.</p>



<p class="kt-adv-heading7850_ce259b-5c wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7850_ce259b-5c">While the project’s start was considered a success, Roche emphasized that the real work starts now.</p>

The project partners acknowledge the valuable advice and support of the Atlantic Canada Opportunities Agency, the Atlantic Fisheries Fund, the Department of Industry, Energy and Technology, and the Department of Fisheries, Forestry and Agriculture.</p>

<p class="kt-adv-heading7850_af7ee0-38 wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7850_af7ee0-38">While the inaugural flight was focused on lobster destined for the Spanish market, the broader strategy includes expansion into France, the United Kingdom, and eventually, high-value Asian markets like South Korea and Japan. This plan not only provides short-term protection for Newfoundland and Labrador’s seafood industry but also creates the opportunity for the province to establish long-lasting, resilient trade corridors for the years ahead. The consortium looks forward to delivering premium-quality, fresh North Atlantic cod from Newfoundland and Labrador to many customers across Europe this fall.</p>



<p class="kt-adv-heading7850_617280-b8 wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7850_617280-b8">As the Gander seafood hub continues to evolve, the success of this pilot project marks the beginning of a new chapter &#8211; one where Newfoundland and Labrador seafood is no longer just ocean-harvested, but also runway-ready.</p>

<p>On February 2, 2025 the United States administration imposed new tariffs under the International Emergency Economic Powers Act (IEEPA) effective February 4, 2025.  The new tariffs are as follows:</p>



<ul class="wp-block-list">
<li>25% tariff on all imports from Mexico and Canada</li>



<li>10% tariff on Canadian energy products</li>



<li>10% additional tariff on all imports from China</li>
</ul>



<p class="kt-adv-heading7689_2cf2d4-8a wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7689_2cf2d4-8a">Subsequent to these new US tariffs, the Canadian government has responded with a 25% Tariff on $30 Billion of goods imported from the U.S. effective February 4, 2025. The list includes products such as orange juice, peanut butter, wine, spirits, beer, coffee, appliances, apparel, footwear, motorcycles, cosmetics, and pulp and paper.</p>



<p class="kt-adv-heading7689_31139d-26 wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7689_31139d-26">The initial list of U.S. origin goods subject to 25% duty can be found&nbsp;<a href="https://www.canada.ca/en/department-finance/news/2025/02/list-of-products-from-the-united-states-subject-to-25-per-cent-tariffs-effective-february-4-2025.html" target="_blank" rel="noreferrer noopener">here</a>.</p>



<p class="kt-adv-heading7689_a7739f-7d wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7689_a7739f-7d">There will be an additional 25% tariff applied to imported U.S. goods worth $125 billion. A full list of these goods will be made available for a 21-day public comment period prior to implementation.</p>

<p>As a first line of defence, Canada&#8217;s robust system of economic support programs is available to help businesses and workers directly impacted by U.S. tariffs. This includes financing and advisory supports for businesses through financial Crown corporations and supports for workers.</p>



<p>Some of the supports that are already available include:</p>

<li><strong>Trade Commissioner Service<br></strong>The&nbsp;<a href="https://www.tradecommissioner.gc.ca/index.aspx?lang=eng">Trade Commissioner Service</a>&nbsp;helps Canadian businesses grow with confidence by connecting them with its funding and support programs, international opportunities, and its network of trade commissioners in over 160 cities worldwide.</li>



<li><strong>Business Development Bank of Canada</strong><br><a href="https://www.bdc.ca/en">Business Development Bank of Canada</a>&nbsp;(BDC) provides financing solutions and advice to small and medium-sized businesses in all industries and at every stage of growth.</li>



<li><strong>Export Development Canada</strong><br><a href="https://www.edc.ca/">Export Development Canada</a>&nbsp;(EDC) helps Canadian companies of all sizes succeed in global markets with trade knowledge, financial solutions, insurance, equity and connections.</li>



<li><strong>Farm Credit Canada</strong><br><a href="https://www.fcc-fac.ca/en">Farm Credit Canada</a>&nbsp;(FCC) is a dedicated lender for the agriculture and agri-food sectors and provides a range of financial products and services to support Canadian farmers and business related to farming.</li>



<li><strong>Canada Small Business Financing Program</strong><br>The&nbsp;<a href="https://ised-isde.canada.ca/site/canada-small-business-financing-program/en/find-loan-your-small-business/helping-small-businesses-get-loans">Canada Small Business Financing Program</a>&nbsp;(CSBFP) makes it easier for small businesses to get loans from financial institutions by sharing the risk with lenders.</li>



<li><strong>Employment and Social Development Canada</strong><br>The&nbsp;<a href="https://www.canada.ca/en/employment-social-development/programs/ei/work-sharing.html">Work-Sharing Program</a>&nbsp;helps employers and employees avoid layoffs, when there is a temporary decrease in the normal level of business activity that is beyond the control of the employer.</li>
</ul>



<p>The government will closely monitor impacts across sectors and the economy, and will bring forward additional measures to support workers and businesses as needed.</p>



<p>The government is also taking steps to mitigate the impact of its tariff countermeasures on Canadian workers and businesses by&nbsp;<a href="https://www.canada.ca/en/department-finance/programs/international-trade-finance-policy/process-requesting-remission-tariffs-that-apply-on-certain-goods-us.html">establishing a remission process</a>&nbsp;to consider requests for exceptional relief from the tariffs imposed as part of Canada&#8217;s immediate response, as well as any future tariff actions.</p>

<h2 class="wp-block-heading">How Does ArriveCAN Work?</h2>



<ol class="wp-block-list">
<li><strong>Entering Canada by Air or Land</strong><br>All travellers entering Canada by air or land (with limited exceptions) <strong>must</strong> use ArriveCAN to submit your travel information <strong>within 72 hours</strong> before your arrival to Canada.</li>



<li><strong>Travelling to Canada by Marine</strong><br>If you travel to Canada by marine, you must submit your travel information through ArriveCAN before or upon entering Canada. We recommend you submit your travel information prior to your journey for faster processing at the border.</li>
</ol>

<h2 class="wp-block-heading">Information Requirements for Travelling to Canada</h2>



<p>Whether travelling to Canada by air, land, or sea, you must use ArriveCAN to submit the following information:</p>



<ul class="wp-block-list">
<li>Travel and contact information for you and other people travelling with you, if you are staying at the same quarantine location</li>



<li>Purpose of travel and travel details (e.g. date of arrival, flight no., etc.)</li>



<li>Reference code for your 3-night reservation at a government-authorized hotel&nbsp;(for air travellers only, unless exempt)</li>



<li>Pre-entry COVID Test information</li>



<li>Information about the countries you stayed in or visited in the 14 days prior to your arrival in Canada</li>



<li>Quarantine plan (unless exempt)</li>
</ul>



<p>Be ready to show your ArriveCAN receipt when you arrive to Canada. A CBSA Officer will verify that you have submitted your information. If you do not submit your information through ArriveCAN, you may:</p>



<ul class="wp-block-list">
<li>Face additional delays at the border for public health questioning</li>



<li>Be subject to enforcement action, ranging from verbal warnings to $1,000 fines</li>
</ul>



<p>Information submitted through ArriveCAN will be shared securely with provinces and territories so travellers can be contacted for public health follow-up and to verify compliance with public health orders. It will also help reduce processing times at the border and limit physical contact between travellers and border services officers.</p>

<h2 class="wp-block-heading">Exemptions for Fully-Vaccinated Travellers</h2>



<p>On July 5, 2021, Canada allowed some exemptions for fully vaccinated travellers who meet specific conditions and are eligible to enter Canada. As a result, you may qualify for exemption from quarantine, hotel stopover, or testing requirements if you:&nbsp;</p>



<ul class="wp-block-list">
<li>Are eligible to enter Canada</li>



<li>Are asymptomatic</li>



<li>Meet the&nbsp;<a href="https://travel.gc.ca/travel-covid/travel-restrictions/covid-vaccinated-travellers-entering-canada" target="_blank" rel="noreferrer noopener">requirements of fully vaccinated travellers</a></li>



<li>Meet all other entry requirements, including submitting your travel information in ArriveCAN before arrival.</li>
</ul>

<h2 class="wp-block-heading">Requirements After Entry to Canada</h2>



<p>If you meet and qualify for exemption as a fully vaccinated traveller, you will not be required to send in reports.</p>



<p>Travellers that do not qualify for fully vaccinated exemption&nbsp;<strong><u>must</u></strong>&nbsp;provide the following information after their entry into Canada.</p>



<p>You must use ArriveCAN or call 1-833-641-0343 to confirm the following:</p>



<ul class="wp-block-list">
<li>Confirm that you have arrived at a government-authorized hotel for quarantine or isolation (air travellers)</li>



<li>Confirm that you have arrived at the address you provided for your quarantine or isolation location</li>



<li>Complete daily COVID-19 symptom self-assessments during your quarantine period or until you report symptoms</li>
</ul>

<h2 class="wp-block-heading">Canada and United States Agree to Remove Steel and Aluminum Tariffs</h2>



<p>In a joint statement on May 17, Canada and the United States announced they have reached an agreement to lift tariffs imposed on steel and aluminum products in 2018.</p>



<p><strong>Effective May 19, 2019</strong>, the agreement applies to the tariffs imposed by the United States in June 2018 under <a href="https://www.cbp.gov/trade/remedies/232-tariffs-aluminum-and-steel" target="_blank" rel="noreferrer noopener">Section 232</a>, as well as <a href="https://www.international.gc.ca/trade-commerce/controls-controles/steel_alum-acier_alum.aspx?lang=eng" data-type="link" data-id="https://www.international.gc.ca/trade-commerce/controls-controles/steel_alum-acier_alum.aspx?lang=eng" target="_blank" rel="noreferrer noopener">Canada’s retaliatory tariffs</a>.</p>



<p>The agreement also includes provisions to:</p>



<ul class="wp-block-list">
<li>Establish a process for monitoring surges in trade in the metals markets;</li>



<li>Prevent transshipment of steel and aluminum made outside of Canada or the United States to the other country; and</li>



<li>Prevent the importation of metals that are unfairly subsidized and/or sold at dumped prices.</li>

<h2 class="wp-block-heading">Background</h2>



<p>On May 31, 2018, the US announced it would impose tariffs on certain steel and aluminum imports from Canada. As a result, Canada imposed surtaxes and similar trade-restrictive countermeasures for selected products originating out of the U.S. The additional 25% or 10% countermeasures came into effect on July 1, 2018.</p>

<p>The Government of Canada is now accepting applications for retaliatory surtax exemptions on the United States <a rel="noreferrer noopener" href="https://www.cbsa-asfc.gc.ca/publications/cn-ad/cn18-08-eng.html" target="_blank">retaliatory surtax</a> assessed or previously paid on certain U.S. origin goods.</p>

<p>Instances that may qualify for the exemption include:</p>



<ul class="wp-block-list">
<li>Situations of short supply within Canada;</li>



<li>Contractual requirements that were in place prior to May 31, 2018 that clearly stipulate U.S. steel or aluminum must be used in their products or projects;</li>



<li>Other exceptional circumstances that could have severe adverse impacts on the Canadian economy. Consideration is given on a case-by-case basis.</li>

<p>Enacted in 1984, the <a rel="noreferrer noopener" href="http://laws-lois.justice.gc.ca/eng/acts/S-15/" target="_blank">Special Imports Measures Act (SIMA)</a> was implemented to protect Canadian industry from potential sales and revenue loss resulting from unfair trade practices by foreign producers. Jointly administered by the <a rel="noreferrer noopener" href="https://www.cbsa-asfc.gc.ca/sima-lmsi/menu-eng.html" target="_blank">Canada Border Services Agency (CBSA)</a> and the <a href="https://www.citt-tcce.gc.ca/en" data-type="link" data-id="https://www.citt-tcce.gc.ca/en" target="_blank" rel="noreferrer noopener">Canadian International Trade Tribunal (CITT)</a>, SIMA provides the legislative framework for the application of trade remedies, including anti-dumping and countervailing duties, on imported goods that are injuriously dumped or subsidized.</p>



<p>Dumping occurs when foreign producers sell their goods in the Canadian market for less than the price of comparable goods in their home markets or when goods are sold to Canadian importers at unprofitable prices. The amount of dumping on imported goods may be offset by the application of “anti-dumping” duty.</p>



<p>Subsidizing occurs when foreign governments provide financial assistance to their producers to reduce the costs of production. Examples of subsidies include tax incentives, grants, or loans at preferential rates. The amount of subsidizing on imported goods may be offset by the application of “countervailing” duty.</p>



<p>The Canadian International Trade Tribunal is responsible for establishing whether the dumping or subsidizing of imported goods is causing injury to Canadian producers. A positive injury decision by the tribunal provides the authority for the CBSA to impose anti-dumping and countervailing duties on dumped or subsidized imports. These duties offset the price advantage caused by dumping or subsidizing and allows Canadian industry the opportunity to compete fairly.</p>



<p>While SIMA duties offer protectionism to Canadian industry, it is important to be aware that the costs and reporting of any applied anti-dumping and countervailing duties become the responsibility of the importer. Therefore, when purchasing products from foreign countries we recommend understanding the types of products that are currently subject to anti-dumping or countervailing measures as well as&nbsp;the detailed costs of the goods being purchased.</p>

<p>Prime Minister Justin Trudeau affixed his signature to&nbsp;the&nbsp;<a rel="noreferrer noopener" href="http://www.international.gc.ca/trade-commerce/trade-agreements-accords-commerciaux/agr-acc/ceta-aecg/index.aspx?lang=eng" target="_blank">Comprehensive Economic and Trade Agreement</a>&nbsp;(CETA) this past weekend. This deal is still not done and is dependent on the European Parliament’s approval and ratification by 28 EU countries, which could take years.</p>



<p>Approximately&nbsp;<a rel="noreferrer noopener" href="http://business.financialpost.com/news/economy/with-restrictions-on-christmas-trees-and-department-stores-ceta-is-almost-a-free-trade-agreement" target="_blank">200 reservations</a>&nbsp;to CETA were made on behalf of Canada’s provinces &amp; territories. One example is Newfoundland and Labrador’s rights to maintain and regulate the exploration and development of hydrocarbons, such as oil production. Other items controlled by Canada include forestry, gambling, natural resources, and alcohol.</p>



<p>Under CETA, duty will be relieved on an estimated 99% of goods. Beneficiaries, such as the textile and agricultural sectors, will obtain a huge advantage. Canada will be able to export larger quotas of pork, beef, and wheat to the EU countries. In turn, EU dairy producers will benefit by the ability to send more than double the amounts of the current quota of “high quality” cheeses to Canada.</p>



<p>CETA opens up major trade lanes for Canada to the EU countries, resulting in a reduced dependency on the USA. The EU market has a potential market to Canadian companies of 508 million consumers, representing an estimated trade boost for Canada of $12 billion Canadian dollars per year. For comparison, Canada’s population is currently&nbsp;<a rel="noreferrer noopener" href="http://www.worldometers.info/world-population/canada-population/" target="_blank">38+ million</a>&nbsp;and the USA,&nbsp;<a rel="noreferrer noopener" href="http://www.worldometers.info/world-population/us-population/" target="_blank">340+ million</a>.</p>

<p>In 2013, a case between Frito-Lay and Canada Border Services Agency (CBSA) provided insight to importers regarding the application of the Most Favoured Nation (MFN) tariff treatment versus applying NAFTA to duty free goods, particularly refund processes&nbsp;and&nbsp;limitation periods applicable to claims under NAFTA tariff preference.</p>



<p>In&nbsp;<a rel="noreferrer noopener" href="https://cscb.ca/sites/cscb.ca/files/uploads/Frito_Lay_v_CBSA-CITT_Decision_and_Reasons.PDF" target="_blank"><em>Frito-Lay v. President of the CBSA</em></a>, the <a rel="noreferrer noopener" href="https://citt-tcce.gc.ca/en" data-type="link" data-id="https://citt-tcce.gc.ca/en" target="_blank">Canadian International Trade Tribunal (CITT)</a> ruled that importers are allowed to make revenue-neutral changes to NAFTA status under Section 32.2 of the Customs Act. CBSA disregarded&nbsp;the CITT decision, resulting in a series of similar court proceedings with&nbsp;Bri-Chem Supply Ltd.,&nbsp;Ever Green Ecological Services Inc., and&nbsp;Southern Pacific Resource Corp.</p>



<p>In each case the Most Favoured Nation (MFN) tariff treatment was applied at the time of importation as the tariff classification was duty free. Although the goods qualified for NAFTA tariff treatment, NAFTA status would not provide any benefit to the rate of duty, and therefore the importers were confident in declaring MFN. The companies were later audited and, as a result, CBSA applied an alternate and dutiable tariff classification to the goods. The importers held NAFTA Certificates of Origin and, therefore, made the assumption that the tariff treatment on the goods could be changed and remain duty free.</p>



<p>Unfortunately, CBSA regulation stipulates that NAFTA status may only be changed within 1 year from the date of accounting against the original release (per transaction). As the audit required adjustments to importations during a 4 year period, the importers were forced to pay duties and taxes for the subsequent 3 year period.</p>



<p>Although the first appeal by Frito-Lay was allowed by the CITT, CBSA maintained their position. Bri-Chem Supply Ltd., Ever Green Ecological Services Inc., and Southern Pacific Resource Corp. all pursued and won appeals at their own expense.&nbsp;CBSA appealed the Bri-Chem decision to the Federal Court.</p>



<p><strong>On October 21, 2016, the Federal Court of Appeal ruled in favour of the Importer and dismissed CBSA’s appeal. The Canadian International Trade Tribunal found that the CBSA’s relitigation of of “Frito-Lay” in this case was an abuse of process. Furthermore, the Federal Court granted the respondents their cost of appeals. Since the appeals were consolidated, one set of costs was awarded.&nbsp;CBSA is expected to provide direction regarding the next steps for the numerous claims currently being held in abeyance.
