<h2 class="wp-block-heading has-text-align-left" style="font-size:25px"><strong>Changes to Steel Quotes</strong></h2>



<p class="has-small-font-size" style="padding-top:var(--wp--preset--spacing--20)"><strong>Information c/o: <a href="https://www.canada.ca/en/department-finance/news/2025/12/government-implements-new-measures-to-protect-canadas-steel-industry.html" target="_blank" rel="noopener" title="">Department of Finance Canada</a></strong><br><br><em>Effective December 26th, 2025, there will be changes to tariff rate quotas and a new 25% tariff assessment for steel and steel products applied <strong>from all countries</strong>. There are two separate changes. </em></p>



<div class="wp-block-kadence-spacer aligncenter kt-block-spacer-8059_ad4555-ec"><div class="kt-block-spacer kt-block-spacer-halign-center"><hr class="kt-divider"/></div></div>



<p class="has-text-align-left">Countries that don’t have a free trade agreement with Canada will be&nbsp;<strong>reduced from 50% to 20%&nbsp;</strong>of 2024 levels, with over-quota volumes continuing to face a 50% surtax. Countries that have a free trade agreement with Canada will see a reduction<strong>&nbsp;from 100% to 75%&nbsp;</strong>of 2024 levels, with over-quota volumes continuing to face a 50% surtax. Canada will continue to honor its existing CUSMA carve-out. As such, the United States and Mexico will continue to be exempted from this requirement.</p>



<h3 class="wp-block-heading has-text-align-left has-medium-font-size"><strong>25% Tariff Assessment</strong></h3>



<p>Initially, a list of steel derivative products will be assessed with a 25% Tariff.&nbsp; It covers goods where steel contact holds a large portion of the full product value. The list will be updated to reflect changes in market conditions.<br><br>The temporary horizontal remission of counter-tariffs on U.S. steel used for manufacturing, processing, food and beverage packaging, or agricultural production will&nbsp;<strong>expire effective January 31, 2026</strong>, with the continued exception of goods used for the manufacturing of automobiles, auto parts, and aerospace products. The horizontal remission of counter-tariffs on aluminum products will also continue beyond January 31, 2026.<br>&nbsp;<br>Importers will still be eligible to apply for remission under the remission framework published by the government on March 4, 2025, which provides for ongoing tariff relief in a&nbsp;narrow set of circumstances, for example, where inputs cannot be sourced domestically.</p>



<h3 class="wp-block-heading has-text-align-left has-medium-font-size"><strong>The Tariff Will Not Apply To</strong>:</h3>



<ul class="wp-block-list">
<li>Goods that are in transit to Canada on the day on which tariffs come into force.</li>



<li>Goods that are subject to a tariff under the&nbsp;<em>China Surtax Order (2024), the United States Surtax Order (Steel and Aluminum 2025),&nbsp;</em>the<em>&nbsp;Order Imposing a Surtax</em>&nbsp;<em>on the Importation of Certain Steel Goods</em>, or the<em>&nbsp;Steel Goods and Aluminum Goods Surtax Order;</em></li>



<li>Casual goods, as defined in section 2 of the&nbsp;<em>Persons Authorized to Account for Casual Goods Regulations</em>;</li>



<li>Goods that are classified under a tariff item of Chapter 98 of the List of Tariff Provisions, even if the goods are otherwise classifiable under a tariff item set out in the schedule;</li>



<li>Goods that are imported before July 1, 2026 for use in the manufacture of motor vehicles or chassis for motor vehicles or in the manufacture of parts of or accessories for motor vehicles or chassis for motor vehicles;</li>



<li>Goods that are imported before July 1, 2026 for use in aircraft, ground flying trainers or spacecraft or in parts of aircraft, ground flying trainers or spacecraft;</li>



<li>Utility wind towers, and sections of those towers, that are classified under tariff item 7308.20.00 and imported for installation in energy projects located west of the Ontario–Manitoba border; and</li>



<li>Goods that are in transit to Canada on the day on which tariffs come into force</li>
</ul>



<h3 class="wp-block-heading has-text-align-left has-medium-font-size"><strong>List of Steel Products Subject to 25% Tariff</strong></h3>



<p>The following provides a <a href="https://www.canada.ca/en/department-finance/news/2025/12/list-of-steel-derivative-products-subject-to-25-per-cent-tariffs-effective-december-26-2025.html" target="_blank" rel="noopener" title="">list of steel derivative products</a> subject to the 25% tariff coming into effect on December 26th. Descriptions are included for illustrative purposes, with the scope established by the tariff classification numbers.</p>

<h3 class="wp-block-heading has-text-align-left has-medium-font-size"><strong>Why Is This Happening?</strong></h3>



<p><strong>Toughen border measures to combat foreign steel dumping.&nbsp;</strong>Strong border enforcement is critical to prevent foreign steel dumping, including through mislabeling or mischaracterization, which threatens Canadian businesses and jobs. Effective enforcement requires up-to-date information, expertise, and resources. To meaningfully strengthen compliance and protect the integrity of Canada’s steel supply chain, the Government, through the Canada Border Services Agency (CBSA), is introducing new measures:<br><br>The CBSA will make it&nbsp;<strong>easier to receive and act on tips</strong>&nbsp;related to non-compliance involving steel goods. This includes enhancements to the secure Border Watch online portal, making it easier for individuals and businesses to provide information related to mis-declared information or other suspected non-compliance. Expanding this channel will support earlier identification of risks and more targeted enforcement activities.<br><br>The CBSA will&nbsp;<strong>work with the Canadian Steel Producers Association</strong>&nbsp;to establish recurring technical workshops that support effective enforcement. These sessions will focus on the technical characteristics of steel products, global supply-chain practices, and the information needed to support enforcement and compliance. Ongoing collaboration will help ensure CBSA officials remain informed about current industry practices and evolving global market conditions.<br><br>The CBSA’s newly established&nbsp;<strong>Market Watch Unit will prioritize timely updates</strong>&nbsp;on steel market prices. The Market Watch Unit analyses trade flows and identifies products that may be at greater risk of being dumped into Canada. The Unit will now prioritize updating normal values for steel products to reflect current production costs, export prices, and global steel market conditions. This will help ensure that trade remedy duties collected on imports are accurate and consistent with evolving global dynamics.<br><br>The CBSA will establish a&nbsp;<strong>dedicated steel trade compliance team</strong>&nbsp;focused exclusively on enforcement activities related to steel. This specialized team will conduct targeted reviews, compliance activities, and focused enforcement in the steel sector.</p>

<p>Effective June 27, 2025, Certain Steel Goods will be subject to Surtax of 50% under a quarterly Quota basis. Global Affairs Canada (GAC) issues Import Permits on a per shipment basis up to 15 days prior to the expected date of arrival in Canada. The permit is valid up to 5 days prior and 14 days after the date of arrival in Canada.</p>



<p class="kt-adv-heading7877_77a1ea-a1 wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7877_77a1ea-a1">GAC will be monitoring the quantities for quota utilization. Importers are responsible for consulting <a href="https://www.international.gc.ca/trade-commerce/controls-controles/steel-acier/index.aspx?lang=eng" target="_blank" rel="noopener" title="">GAC’s online reports</a> to track quota availability. CBSA will automatically apply the Surtax to all shipments without a shipment-specific permit, regardless of whether a permit is pending or unavailable at time of clearance. There is no limit to the quantities of steel that may enter Canada under General Import Permits (GIP), but such imports will be subject to the 50% Surtax.</p>



<p class="kt-adv-heading7877_73fa2e-b1 wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7877_73fa2e-b1">It is important to note that valid permits only relate to this order and do not relieve any other customs duties, anti-dumping, countervailing duties, surtaxes, or taxes. Surtaxes and/or SIMA are stackable. End use tariff items under Chapter 99 will not remove the 50% Surtax.</p>



<p class="kt-adv-heading7877_05873e-00 wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7877_05873e-00">Importers must provide the Import Permit or GIP along with Country of Melt and Pour (COM) information to obtain release of the goods into Canada.</p>



<p class="kt-adv-heading7877_5a4946-1a wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7877_5a4946-1a">Goods in transit up to June 27th are exempt and must provide proof by way of Bills of Lading.<br><br>Attached is a list of applicable tariffs and countries exempt from this order.</p>

<li>If your goods fall under the tariff codes listed in <a href="#schedule1" title="Schedule 1">Schedule 1</a>, they are subject to quota restrictions and the 50% surtax applies beyond those quotas.<br> </li>
</ul>
</li>



<li><strong>Apply for Import Permits Early</strong>
<ul class="wp-block-list">
<li>Shipment-specific permits can be requested up to 15 days before your steel arrives in Canada. Without a valid permit, the 50% surtax will be charged automatically at the time of clearance.<br> </li>
</ul>
</li>



<li><strong>Track Quota Usage</strong>
<ul class="wp-block-list">
<li>Global Affairs Canada monitors available quotas in real-time. It’s your responsibility to check quota levels before shipping to Canada to avoid unexpected costs.<br> </li>
</ul>
</li>



<li><strong>Prepare Documentation</strong>
<ul class="wp-block-list">
<li>To release your goods, you must present:

<p id="schedule1">Schedule 1 contains a complete list of goods subject to the surtax, specifically the steel products and their tariff classifications (HS codes) that are subject to the surtax or fall under the quota system. The value for duty is determined in accordance with sections 47 to 55 of the <em>Customs Act</em>. </p>

<p>Avoid unnecessary costs and delays by watching for these common pitfalls:</p>

<li><strong>Assuming GIP Exempts Surtax</strong>
<ul class="wp-block-list">
<li>General Import Permits (GIP) allow unlimited importation, but all GIP shipments still face the 50% surtax. Only shipment-specific permits prevent the surtax, provided they are obtained in advance and within quota limits.<br> </li>
</ul>
</li>



<li><strong>Shipping Without Checking Quota Levels</strong>
<ul class="wp-block-list">
<li>Quota fills quickly. If the quota is exhausted when your goods arrive, even if a permit is pending, the 50% surtax applies. Always consult Global Affairs Canada&#8217;s Quota Monitoring System before shipping.<br> </li>
</ul>
</li>



<li><strong>Missing Permit Deadlines</strong>
<ul class="wp-block-list">
<li>Import Permits are valid from 5 days before to 14 days after the expected arrival date. Applying late or incorrect timing can void the permit, triggering the surtax.<br> </li>

<li><strong>Inadequate Documentation</strong>
<ul class="wp-block-list">
<li>Failure to provide the required Country of Melt and Pour (COM) documentation or proof of goods in transit prior to June 27th will result in delays or the application of surtax.<br> </li>

<li><strong>Overlooking Additional Duties</strong>
<ul class="wp-block-list">
<li>Even with a valid permit, you may still face anti-dumping duties, countervailing duties, SIMA measures, or other surtaxes. These apply separately and are stackable.</li>

<p>On February 2, 2025 the United States administration imposed new tariffs under the International Emergency Economic Powers Act (IEEPA) effective February 4, 2025.  The new tariffs are as follows:</p>



<ul class="wp-block-list">
<li>25% tariff on all imports from Mexico and Canada</li>



<li>10% tariff on Canadian energy products</li>



<li>10% additional tariff on all imports from China</li>
</ul>



<p class="kt-adv-heading7689_2cf2d4-8a wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7689_2cf2d4-8a">Subsequent to these new US tariffs, the Canadian government has responded with a 25% Tariff on $30 Billion of goods imported from the U.S. effective February 4, 2025. The list includes products such as orange juice, peanut butter, wine, spirits, beer, coffee, appliances, apparel, footwear, motorcycles, cosmetics, and pulp and paper.</p>



<p class="kt-adv-heading7689_31139d-26 wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7689_31139d-26">The initial list of U.S. origin goods subject to 25% duty can be found&nbsp;<a href="https://www.canada.ca/en/department-finance/news/2025/02/list-of-products-from-the-united-states-subject-to-25-per-cent-tariffs-effective-february-4-2025.html" target="_blank" rel="noreferrer noopener">here</a>.</p>



<p class="kt-adv-heading7689_a7739f-7d wp-block-kadence-advancedheading" data-kb-block="kb-adv-heading7689_a7739f-7d">There will be an additional 25% tariff applied to imported U.S. goods worth $125 billion. A full list of these goods will be made available for a 21-day public comment period prior to implementation.</p>

<p>The government will closely monitor impacts across sectors and the economy, and will bring forward additional measures to support workers and businesses as needed.</p>



<p>The government is also taking steps to mitigate the impact of its tariff countermeasures on Canadian workers and businesses by&nbsp;<a href="https://www.canada.ca/en/department-finance/programs/international-trade-finance-policy/process-requesting-remission-tariffs-that-apply-on-certain-goods-us.html">establishing a remission process</a>&nbsp;to consider requests for exceptional relief from the tariffs imposed as part of Canada&#8217;s immediate response, as well as any future tariff actions.</p>

<h2 class="wp-block-heading">Canada and United States Agree to Remove Steel and Aluminum Tariffs</h2>



<p>In a joint statement on May 17, Canada and the United States announced they have reached an agreement to lift tariffs imposed on steel and aluminum products in 2018.</p>



<p><strong>Effective May 19, 2019</strong>, the agreement applies to the tariffs imposed by the United States in June 2018 under <a href="https://www.cbp.gov/trade/remedies/232-tariffs-aluminum-and-steel" target="_blank" rel="noreferrer noopener">Section 232</a>, as well as <a href="https://www.international.gc.ca/trade-commerce/controls-controles/steel_alum-acier_alum.aspx?lang=eng" data-type="link" data-id="https://www.international.gc.ca/trade-commerce/controls-controles/steel_alum-acier_alum.aspx?lang=eng" target="_blank" rel="noreferrer noopener">Canada’s retaliatory tariffs</a>.</p>



<p>The agreement also includes provisions to:</p>



<ul class="wp-block-list">
<li>Establish a process for monitoring surges in trade in the metals markets;</li>



<li>Prevent transshipment of steel and aluminum made outside of Canada or the United States to the other country; and</li>



<li>Prevent the importation of metals that are unfairly subsidized and/or sold at dumped prices.</li>

<h2 class="wp-block-heading">Background</h2>



<p>On May 31, 2018, the US announced it would impose tariffs on certain steel and aluminum imports from Canada. As a result, Canada imposed surtaxes and similar trade-restrictive countermeasures for selected products originating out of the U.S. The additional 25% or 10% countermeasures came into effect on July 1, 2018.</p>
